Mr E F Guyton to Belton Parish Council
Duplicate Conveyance
of a piece of land known as Fraylands
in the parish of Belton in the County of Suffolk.
This conveyance is made on the 28th day of May 1947 BETWEEN Ernest Frederick Guyton of Waveney Nurseries Belton in the county of Suffolk, Market Gardener (hereafter called the Vendor) of the first part Horace Raikes Dashwood (chairman), Edward Samuel Stimpson (vice-chairman), William Percival Beck (treasurer), John Larter (secretary), Ernest Abbs, Dorothy Charlotte Beck, Edgar Alfred Farman, Elsie Mary Guyton, Ernest Edward Morse, Fred George Searby, Gladys Minnie Searby and Alfred Tennant (members) all of Belton aforesaid together forming the Committee of The Belton Services Welcome Home Fund (hereinafter called the Committee) of the second part and the BELTON PARISH COUNCIL (hereinafter called the Council) of the third part.
WHEREAS the Vendor is seised of the property hereinafter described and conveyed for an estate of fee simple free from encumbrances and has agreed to sell the same to the Committee at the price of Four hundred and sixty pounds.
AND WHEREAS The Committee has requested the Council to act as trustees of the said property and to hold the same for the purposes authorised by the Recreation grounds Act 1859 or some of themselves
NOW THIS DEED WITNESSETH as follows :-
1 – In pursuance of the said agreement and in consideration of the sum of four hundred and sixty pounds now paid out of monies raised this purpose by the Committee in the said Parish to the Vendor who hereby acknowledges the receipt thereof he the vendor as beneficial owner doth hereby by the direction of the Committee grant and convey unto the Council
ALL THAT piece of land situate in the parish of Belton and forming part of the field numbered 281 on the Ordnance Survey Map of the said parish known as Fraylands which said piece of land is bounded towards the North by Bell lane, towards the East by a public footpath (the centre of which forms the actual boundary line) , towards the South by other land of the vendor and towards the West by lands of T Simpson and is with measurements and abuttals thereof more particularly delineated in the plan drawn hereon and therein edged red.
TO HOLD unto the Council in fee simple
2 – THE COUNCIL hereby declare that they will hold the said land UPON THE TRUSTS following namely as public ground for the purpose of the recreation grounds Act 1859.
3 – IT is hereby agreed and declared that the management and direction of the land hereby conveyed shall be and remain in the persons for the time being forming the Committee of the Belton Services Welcome Home Fund in accordance with the provisions of the first part of the Schedule hereto.
4 – THE Committee hereby covenant with the Vendor that they
a) will forthwith erect and hereafter posts and wire fences of a height not less than five feet with four feet of wire netting of not more than six inch mesh one foot above ground level and one strand of smooth wire six inches above ground level or with five feet of wire netting of not more than six inch mesh along the East boundary of the land hereby conveyed on a line two feet from the centre of the public footpath and along the South boundary of the said land on a line two feet within such boundary and
b) will not make or erect or permit to be made or erected any opening style or gateway in such fences and
- will use the said land for the purpose of a playing field for the Parish of Belton only.
- 5 – THE Vendor hereby acknowledges the right of the Council to production of the deeds specified in the second part of the Schedule hereto and to delivery of copies thereof and hereby undertakes for the safe custody thereof.
- 6 – IT is hereby certified and declared that the transaction hereby effected does not form part of a larger transaction or a series of transactions in respect of which the amount or value of the aggregate amount of value of the consideration exceeds the sum of Five Hundred Pounds.
- IN WITNESS whereof the parties hereto set their hands and seals the day and year first before written.
THE SCHEDULE above referred to
First Part
1- The land hereby conveyed shall be sued as a Playing Field for the benefit of the inhabitants of the Parish of Belton including the hamlet of Browston under the management and direction of the Belton Services Welcome Home committee.
2 – The Committee shall consist of twelve members seven to form a quorum.

3 – Four of the first Committee (to be drawn by Lot) shall cease to hold office on the First day of march One thousand nine hundred and forty seven but shall be eligible for re-election. Four other members of the first Committee (to be drawn by Lot) shall cease to hold office on the First day of March One thousand nine hundred and forty eight but shall be eligible for re-election. Subject thereto the term of office of members shall be three years expiring on the First day of March. Three members to fill the vacancies so caused shall be elected by show of hands at the Annual Parish Meeting and one member shall be co-opted by the Committee at its first meeting next after the Annual Parish Meeting.
4 – If the Committee shall desire to sell the said land or to use it for any purpose other than as a Playing Field the Committee shall put such proposal in writing and shall submit it to the next Annual Parish Meeting. If the proposal shall then be approved on a vote by show of hands by a majority of those present and voting the proposal shall then be adjourned to the Annual Parish Meeting in the following year and if the same shall then be approved on a similar vote by show of hands the proposal shall then be submitted to the Minister of Education for approval. On this approval being granted, the proposal shall then be carried into effect. In the event of such sale the net proceeds of the sale shall be used to defray all outstanding accounts due from the Committee and the balance thereof and any other monies in the hands of the Committee be applied by the Committee for such purposes as the Committee shall determine having regard for the needs of the Parish of Belton at the time.
5 – In the event of any member or members of the Committee dying or resigning or becoming incapable of acting during his,her or their term of office the Committee shall have power to fill such vacancy by co-opting a substitute to complete the term of office of such member or members.
6 – If at any future time the Committee shall cease to exist the Parish Council shall have full power to manage the said land in accordance with the Recreation Grounds Act 1859 or to exercise any powers in relation thereto conferred on them by statute.
